Those stolen goods were loaded into the vehicle, and Jones left while Almazon stayed and tried stealing a truck from the home with keys he’d found inside.Underwood said the homeowner’s son and his friend who owned the truck encountered Almazon while he was attempting to steal the truck.Witnesses said Almazon tried to run over the homeowner’s son with the truck, and that’s when the truck’s owner fired several shots.Underwood said Jones was later taken into custody and charged with third-degree burglary and first-degree property theft, but he may be facing additional charges.“We will not be pursuing criminal charges against the shooter because we believe the evidence shows this is a case of justifiable homicide,” Underwood said. “We’ve also consulted with the district attorney, as they have the ultimate prosecutorial discretion with criminal cases.last_img
